Moorings Agreement

Southampton Sailing Club Moorings Agreement

Purpose

1 This licence is issued subject to the Rules and Byelaws of Southampton Sailing Club as current at the time of issue. It constitutes an annual agreement between Southampton Sailing Club and the member (hereinafter also referred to as 'the licensee) whose name appears above regarding the provision of a club mooring.

2 No express or implied warranty of the fitness of the mooring is given by the Club and the Licensee undertakes to make no claims against the Club for any damage they may suffer arising out of the use of this mooring for their craft. It is the duty of the licensee to ensure that the craft is properly secured to the mooring and to bring to the immediate attention of the Moorings Master any damage to or fault with the mooring tackle supplied by the Club.

Joint Ownership

3 Where a craft is jointly owned, ALL parties to the joint ownership must be full members of the Club.

Insurance

4 All craft must carry a minimum of third party insurance cover. Members are to attest to having this insurance at all times, and will provide evidence to the club secretary. Failure to do so may mean invalidation and termination of membership.

Allocated mooring

5 The licensee must use the mooring allocated for the craft described. Should the Licensee wish to use the mooring for another vessel, the licensee must discuss with an officer of the club the suitability of the mooring for the intended craft. A new mooring licence must be obtained if any details change.

Maximum Size of Vessel

6 The Licensee shall only use the mooring for a craft not exceeding 9 metres L.O.A. and not exceeding 4 tonnes gross weight. These are MAXIMUM measurements.

Safety and Security

7 The licensee is responsible for the proper maintenance of the craft and shall not make the Club in any way responsible for the safety or custody of the craft and the gear, fittings or property thereon.

8 The Club Mooring Master reserves the right to take such action as may be required to ensure the safety of other craft on the moorings and to comply with any request from or obligation to ABP Southampton.

Nuisance, damage and danger to others

9 The Licensee shall not do or permit upon the craft anything which may cause a nuisance, damage, danger, or annoyance to other mooring holders or to persons on or about the mooring area or shore and shall not obstruct access to and from the moorings nor the slipway. In particular, when disposing of waste from the vessel, the licensee must adhere to the requirements of the Club's Port Waste Management Plan and such notices as may be issued by the Club from time to time.

Limitations

10 The licensee shall not occupy as a residence, nor permit any person or persons to occupy as a residence any craft moored to this mooring.

11 The licensee shall not transfer or sub-let the mooring to any other person.

Payment of fees

12 The licensee shall pay the Club the current mooring charge as shown on the Club Membership Renewal Notice within 30 days of receipt of the Notice. Should no payment be received, the Club may re-allocate the mooring.

13 The mooring charge once paid is non-refundable and may not be offset against compound charges.

Mooring start and end dates

14 All moorings must be vacated by the 1st December and may not be occupied again until 1st March in the year immediately following. Any licensee not complying with this will forfeit the mooring in that year. Any craft remaining on the mooring beyond 1st December may be removed by the Officers of the Club at the owner's risk and expense.

Termination of this licence

15 If the licensee terminates their Club membership the license will cease to have effect.

16 A licensee who for any reason will not be using the mooring allocated must inform the Club Mooring Master so that the mooring may be used by another member of the Club. If any licensee does not use their mooring for one full year (1st December to 1st December) they will be asked to provide evidence of their intentions for the following year. If no evidence is produced the name of the licensee will be transferred to the mooring waiting list and the mooring re-allocated.
