Southampton Sailing Club Compound Agreement
Purpose
1 This licence is issued subject to the Rules and Byelaws of Southampton Sailing Club as in force at the time of issue. It constitutes an annual agreement between Southampton Sailing Club and the member whose name appears above (hereinafter also referred to as 'the licensee') regarding the storage of boats and equipment in the club compound.
2 The Club gives no express or implied warranty as to the fitness or the security of the Club compound and this license is issued on the understanding that the licensee shall make no claim against the Club or hold it or any Club Officer responsible for any damage or loss the licensee may suffer arising out of use of the Club compound.
Marking of boats and equipment
3 The craft (and any related equipment such as tenders, cradles, trailers and outboards if stored in the compound) shall be marked with its name and/or the member's name and/or such other method of identification as may be determined by the Committee, in an easily readable position. Any additional or replacement craft etc that the member wishes to store in the compound will be the subject of a separate application and license.
Joint ownership
4 Where a craft is jointly owned, ALL parties to the joint ownership must be full members of the Club.
Insurance requirements
5 It is a requirement that all craft must carry a minimum of Third Party insurance cover including a minimum of £2 million of public liability insurance. Members are to attest to having this insurance at all times, and will provide evidence to the club secretary. Failure to do so may mean invalidation and termination of membership.
Safety and security
6 The licensee shall keep the craft in a safe and secure condition at all times. Dinghies and other trailed craft must be kept on serviceable trailers or trolleys and lashed down. Fin or lifting keel craft must be supported by a cradle or trailer. Where masts are left stepped, the licensee MUST secure legs or props on either side of the craft and prop the bow, irrespective of the craft or cradle.
7 Ladders stored in the compound for the purpose of boat maintenance etc must be locked in a position that prevents their use for unauthorized access to any vessel and/or the perimeter fence.
Movement of boats
8 The Club reserves the right to take such actions as may be required to ensure the efficient management of compound space and secure the safety of other craft in the compound and any of the Club's Officers has the right to move, or cause to be moved to another part of the compound, any craft at any time. There will be no charge for a boat moved within the compound at the instigation of the club (but see 10 below).
9 Where trailer locks or similar security measures are employed that prevent the movement of a boat and/or trailer the licensee must make sure that the Club has a key to be able to move the boat and/or trailer. The Club will endeavor to give due notice of any movement of a boat and/or trailer so that the owner may be present but reserves the right for any of the Club's Officers to move, or cause to be moved, boats and/or trailers in line with 3 above.
10 There will be an additional charge (separate to the lift in/out charge) as determined from time to time by the committee for moving or lifting boats in the compound at the licensee's request.
Nuisance, damage and danger to others
11 The licensee shall not do or permit anything on the craft that may cause nuisance, damage, danger or annoyance to other compound users or to persons on or about the Club's premises, the near vicinity including the neighbouring properties, the path past the compound and the foreshore. Children under 10 years of age and animals are not allowed in the compound unless under adult supervision. Halyards and other running rigging must be secured to prevent flogging. Access to the compound and slipway must remain unobstructed.
12 The licensee is responsible for the conduct of any contractor employed by them to work on their boat in the compound and shall ensure that contractors are informed of the conditions of the previous paragraph. The licensee also agrees to notify the Committee in advance of any work being carried out by a contractor in the.
Limitations
13 The licensed compound space shall not be transferred or sub-let by the licensee. The stored craft shall not be used as a residence by the licensee or other person(s).
Disposal of rubbish
14 Rubbish and hazardous waste (including engine lubricants and fuel and other liquids) produced by the licensee must be restrained in a secure dustbin liner or appropriate container and disposed of safely by the licensee in line with the club waste management plan and such notices as may be issued by the Club from time to time.
Payment of fees and related matters
15 The licensee shall pay the Club the appropriate fees on a date determined by the Committee and in any event, prior to placing the craft in the compound.
16 Any craft not removed from the compound prior to the end of the relevant storage period will be liable to an overstay charge as set out in the byelaws. A minimum overstay fee equivalent to one month's overstay fee will be levied for any part of each month of overstay. The storage periods are:
Winter: Cruisers 1st Oct to 31st May. Dinghies 1st Nov to 31st March
Summer: Cruisers 1st June to 30th Sept. Dinghies 1st April to 31st Oct.
17 No vessel may remain in the compound for more than one year without being substantially worked on or launched unless permission has been given by the Committee. Vessels stored beyond this period will be subject to a 50% increase in compound fees for each of the next two years if the vessel has not been launched or significant progress has not been made on any outstanding work. If after 3 years, the vessel is still subject to increased fees (i.e. has not been launched or worked on to the satisfaction of the Committee), the owner of the vessel shall be asked to remove it from the compound and be given a reasonable timescale in which to do this. Failure to remove the vessel within this timescale shall result in the member being expelled from the Club and legal proceedings started to ensure the removal of the vessel concerned and the recovery of any costs due to the club.
Termination of this licence
18 If the licensee terminates his/her membership, or it is terminated by the Club Committee, this compound license shall immediately cease to have effect. Any craft or equipment belonging to the licensee that remains in the compound after a period of 30 days from the termination of membership will be disposed of by the Club in accordance with the Articles of Association and Byelaws.
Sale of boats
19 Should the licensee decide to sell the vessel whilst it is in the compound, the licensee agrees to notify the committee in advance. If there is a transfer of ownership the licensee must inform the Committee of the new owner and arrangements for the vessel's removal if the vessel has been sold to a non-member. No vessel may be removed unless any outstanding fees are paid. There is no guarantee that the new owner, if not already a member of the club, will be approved as a member and it is the licensee's responsibility to make this clear to any prospective purchaser.
Storage of tenders and outboards
20 Where the licensee has purchased a mooring, a tender may be kept in the compound at no additional charge. The tender must be clearly marked in line with paragraph 3 above and also carry the name of the vessel to which it is the tender. Tenders should be under 12' in length unless otherwise agreed by the Committee and stored in a manner that does not cause nuisance to other members. Only one tender per boat is permitted, additional tenders will be subject to the normal charge for storing a dinghy. Tenders for boats not on the moorings will likewise be subject to the dinghy storage fee.
21 Space permitting and subject to approval by the Compound Master and paragraph 20 above, an outboard for the tender may be stored in the shed in the compound designated for that purpose. An outboard so stored is stored at the licensee's risk and must be marked as required under paragraph 3 above. Fuel containers must not be stored in the outboard shed.
